Terms of Service

Legal notice

By hiring the services of Yacht Site, hereinafter referred to as "the Company," you agree to the following terms, which constitute a binding agreement between the client and the Company. It is recommended to read carefully before proceeding with any booking.

  1. Liability Disclaimer
    1.1. By boarding any vessel provided by the Company, you confirm that you do so of your own free will and at your own risk. You release the Company, its employees, representatives, and/or intermediary agencies from any civil, criminal, or administrative liability for accidents, damages, or injuries that may occur during the service.

1.2. Clients acknowledge that they have received the relevant safety instructions from the staff before boarding. They also accept the regulations that restrict participation of:

  • Persons over the age of 60.

  • Persons with health conditions that limit aquatic activities (cardiac, respiratory, motor, or other medical issues).

  • Persons under the influence of alcohol or other substances.

1.3. Any activity undertaken under these circumstances will be the sole responsibility of the client, who releases the Company from any present or future claims.

1.4. Failure to comply with the safety instructions provided by the staff may result in the immediate termination of the service without a refund.

  1. Cancellations and Changes
    2.1. No refunds or discounts will be provided if:

  • The client cancels the trip.

  • The client decides to return before the end of the tour.

  • The client fails to show up at the meeting point at the agreed time.

2.2. Changes to the booking are subject to the Company's approval and must be requested at least 72 hours in advance.

2.3. In case of adverse weather conditions:

  • If maritime authorities prohibit navigation, the deposit will be refunded.

  • If the weather changes during the trip, no refunds will be provided.

2.4. Force majeure events, such as natural disasters, pandemics, or civil conflicts, will be assessed on a case-by-case basis. The Company may offer reasonable rescheduling options but does not guarantee refunds.

2.5. If the client is not ready to board at the agreed time, only the remaining scheduled time will be available. If less than 4 hours of service remain, trips to Isla Mujeres will not be possible.

2.6. If the client decides to disembark at Isla Mujeres and does not return to the boat at least an hour and a half before the end of the tour, the vessel will return to the original marina to avoid delays. If the scheduled time is exceeded, the corresponding additional cost must be covered.

  1. Liability for Damages
    3.1. The client will be responsible for any damage caused to:

  • The vessel (burns, breakages, mechanical issues, etc.).

  • Additional equipment such as jet skis (whether rented from third parties or directly from the Company).

  • Transportation vehicles provided by the Company.

3.2. Payment for damages must be made immediately, according to the valuation provided by the Company or specialized third parties.

3.3. The Company reserves the right to deny future services to clients who have caused damage or breached these terms.

3.4. The Company is not responsible for the loss, theft, or damage of clients' personal belongings during the service.

3.5. Clients bringing large equipment such as professional cameras, drones, or coolers must declare them before boarding and are responsible for their transportation.

  1. Additional Services
    4.1. Services such as food, decorations, personalized experiences, air conditioning use, or grills must be booked with a 50% deposit before departure. This payment is non-refundable in case of cancellation by the client.

4.2. A 15-minute grace period is allowed for boarding transportation. If the client is not ready within this timeframe, the transportation will leave without the possibility of a refund.

4.3. Exceeding the maximum number of passengers specified in the booking, in compliance with maritime and safety regulations, is not permitted.

4.4. The use of unauthorized electrical or electronic devices (e.g., portable speakers or kitchen appliances) that could damage the yacht's infrastructure is strictly prohibited.

4.5. Clients wishing to bring their own food or beverages must adhere to the Company's conditions (e.g., prohibition of glass containers and moderate alcohol consumption).

  1. Captain’s Authority
    5.1. The captain of the vessel is the highest authority on board. They have the right to:

  • Terminate the service if the safety of passengers, crew, or the vessel is compromised due to clients' behavior (e.g., intoxication, imminent danger, etc.).

  • Decide on alternative routes in case of bad weather or emergencies.

5.2. If the service is interrupted for any of the above reasons, no refunds will be issued.

  1. Technical Failures or Inconveniences
    6.1. The Company does not own the vessels and is therefore not responsible for mechanical failures or technical inconveniences. However, it commits to:

  • Providing reasonable solutions to compensate for the inconvenience.

  • Managing viable alternatives within the business's capabilities.

6.2. The Company selects reliable providers but does not guarantee the absence of unforeseen defects. In the event of a significant mechanical failure, reasonable compensation options will be evaluated.

  1. Exchange Rates and Payments
    7.1. Service prices will be set in the local currency, and any conversion to international currencies will follow the exchange rate previously stipulated by the Company.

7.2. Adjustments based on fluctuating third-party exchange rates will not be accepted.

  1. Medical Assistance Services
    8.1. The Company offers medical assistance services in case of accidents at an additional cost. These services must be booked prior to departure. If not booked, the Company will not include medical assistance as part of the service.

8.2. Any situation arising from the client's actions or negligence will be their sole responsibility.

  1. Participation of Minors
    9.1. Minors must be accompanied by a responsible adult who assumes full responsibility for their safety and behavior.

By hiring the services of Yacht Site, the client declares having read and accepted these terms in full. This document is designed to ensure safety, clarity, and compliance with the regulations in the sector.
